DMCA Policy

OpenClaw Index ("we," "us," or "our") respects the intellectual property rights of others and expects users of openclawindex.com (the "Site") to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

1. What This Policy Covers

OpenClaw Index is a content aggregation directory that crawls publicly available sources, creates brief summaries and excerpts, and links back to original content. We do not host full copies of third-party copyrighted works. However, if you believe that any content on our Site infringes your copyright, this policy explains how to notify us and how we will respond.

This policy applies to:

  • Summaries, excerpts, or descriptions of third-party content displayed on the Site
  • Thumbnails, preview images, or metadata aggregated from external sources
  • Any other material on the Site that you believe infringes your copyright

2. How to Submit a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of one) and believe that content on the Site infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include all of the following elements to be considered valid under the DMCA:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
  2. Identification of the infringing material: The specific URL(s) on the Site where the allegedly infringing material is located. You must provide enough detail for us to locate the material (e.g., direct page links rather than general site references).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please ensure your claim is valid before submitting a notice.

3. Where to Send Takedown Requests

For fastest processing, please send your notice via email with the subject line "DMCA Takedown Notice" and include all required elements listed in Section 2 above.

4. Our Response Process

Upon receiving a valid DMCA takedown notice, we will follow this process:

  1. Acknowledgment: We will acknowledge receipt of your takedown notice within 48 hours of receiving it.
  2. Review: We will review the notice for completeness and validity. If the notice is incomplete, we will notify you and request the missing information.
  3. Removal: If the notice is valid and complete, we will remove or disable access to the allegedly infringing material within 7 business days of receiving the valid notice.
  4. Notification to content source: If applicable, we will make reasonable efforts to notify the party whose content was removed, providing them with a copy of the takedown notice and information about how to submit a counter-notification.

5. Counter-Notification Process

If you believe that material removed from the Site in response to a DMCA takedown notice was removed as a result of mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Identification of removed material: Identification of the material that was removed and the URL where it previously appeared on the Site.
  2. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the jurisdiction of any judicial district in which OpenClaw Index may be found), and that you will accept service of process from the person who submitted the original DMCA notice or an agent of such person.
  4. Good faith statement: A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  5. Signature: Your physical or electronic signature.

Send counter-notifications to dmca@openclawindex.com with the subject line "DMCA Counter-Notification."

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action against you within 10 business days, we may restore the removed material.

6. Repeat Infringers Policy

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, access for users or content sources that are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Site or permanently remove content from any source against which multiple valid DMCA takedown notices have been filed.

7. Fair Use Statement

OpenClaw Index operates as a content aggregation and indexing service. Our use of third-party content is guided by fair use principles under 17 U.S.C. § 107. Specifically:

  • We summarize, we do not reproduce: We create brief summaries and excerpts of publicly available content. We do not reproduce full articles, blog posts, or other copyrighted works.
  • We link back to original sources: Every aggregated item on the Site includes a direct link to the original content, driving traffic to the original creator's platform.
  • Transformative purpose: Our summaries serve an informational and indexing purpose that is distinct from the original works. We organize and categorize content to help users discover resources in the OpenClaw ecosystem.
  • Limited scope: We use only the minimum amount of content necessary to provide meaningful descriptions and help users determine whether to visit the original source.

Notwithstanding the above, we respect the rights of copyright holders and will promptly address any valid concerns through our DMCA process.

8. Content Removal for Non-Copyright Reasons

We understand that individuals and organizations may have reasons beyond copyright for wanting content removed from our index. If you would like to opt out of having your content aggregated on OpenClaw Index for any reason, you may submit an opt-out request:

  • Individual opt-out: If your personal information (name, likeness, or other identifying details) appears in aggregated content on the Site and you wish to have it removed, please contact us at legal@openclawindex.com.
  • Source opt-out: If you are a website owner or content publisher and wish to prevent your content from being indexed by OpenClaw Index, please contact us at legal@openclawindex.com. We also honor standard robots.txt directives.

We will process non-copyright removal requests within 7 business days.

9. Limitations

Please note the following limitations of this policy:

  • This DMCA policy applies only to content available on openclawindex.com. We cannot remove content from third-party websites.
  • We are not liable for content on external websites that we link to. If you have a concern about content on an external website, you must contact that website's operator directly.
  • We reserve the right to determine, in our sole discretion, whether a takedown notice is valid and complete before taking action.

10. Changes to This Policy

We may update this DMCA Policy from time to time. When we make changes, we will revise the "Last Updated" date at the top of this page. We encourage you to review this policy periodically.
